E-store terms of use

1. General terms

1.1. The online store of Suvesuss sells handmade leather shoes (hereinafter referred to as the Products) at the online store www.suvesuss.ee owned by Suvesuss OÜ.

1.2. The conditions apply to the legal relationships that arise between the customer (hereinafter referred to as the Customer) and Suvesuss OÜ (hereinafter referred to as the Seller) as the owner of the shopping environment located on the website www.suvesuss.ee (hereinafter referred to as the Online Store) when Products are bought from the online store. In addition to these conditions, the legal relationships that arise when Products are bought from the Online Store are also regulated by the legislation of the Republic of Estonia.

2. Prices

2.1. All prices displayed in the Online Store are given in euros and include VAT.

3. Products

3.1. Usually, the Products displayed in the Online Store are in stock. The availability of the said Products is not guaranteed, since it can be erroneous due to possible technical problems in the Online Store’s programmes.

3.2. If the Customer places an order but it appears that the given Product is out of stock, the Online Store cannot execute that order. In this case, an employee of the Online Store will contact the Customer and offers possibility to replace the missing Product with the Product which is available or will refund money for the purchase.

3.3. The photos displayed of the Products and their colors in the Online Store are illustrative and may differ from the actual appearance of the Product color to a small extent.

4. Making a purchase

4.1. The Customer selects a desired Product from the Online Store and adds it to the shopping cart by clicking on the button “ADD TO BAG”.

4.2. To place the order, the Customer must click on the button “CHECKOUT”, after which the Customer is forwarded to the order placement page. After entering the required data, the Customer will pay for the product through an internet bank link and confirm the order by clicking on the button “Return to Merchant”.

4.3. When the Customer has paid for the Product, the Online Store will send a confirmation to the Customer’s e-mail address.

4.4. The Customer is obligated to provide necessary and correct information when the order is placed.

4.5. The Seller takes no responsibility for not being able to execute the order or any consequences that arise due to incorrect information given by the Customer during the placement of the order.

4.6. The Seller has the right to refuse to fill the order if there is a doubt the data presented to the Seller is incorrect or if the conduct is not in accordance with good practice.

5. Methods of payment

5.1. The Customer can pay for their orders via Estonian banklinks (Swedbank, SEB, Nordea, Danske, LHV, Krediidipank, Coop) and via bank transfers.

5.2. The payment is carried out outside the online store of Suvesuss in a secure paying environment of service provider Paysera (http://paysera.com).

5.3. The Seller does not have access to the Customer’s bank or credit card information.

6. Delivery

6.1. Customer can choose between given shipping options. Delivery time depends of the chosen option.

6.2. When choosing Omniva or Smartpost (Estonia) parcel machine shipping option, product will be delivered to the customer in 1-3 days after order confirmation to the customer has been sent. Customer will be notified via SMS once the Product has arrived. SMS includes door code, location of the parcel machine, return code and until which date the package will be kept in the parcel machine. Product is kept in the parcel machine for 7 days. After 7 days when the Customer has not picked up the Product, it will be sent back to the E-Store. Customer needs to pay a fee for new sending incase the Product was not picked up on time.

6.3. Customer should keep the SMS named in point 7.4 for 14 days incase there is a need to return the Product. Customer has a possibility to exchange or return the Product by using the return code in received SMS.

6.4. When choosing Postal Office (Estonia) shipping method, product will be delivered to the customer in 5 days after order confirmation to the customer has been sent. Customer will be notified via SMS once the Product has arrived to the Postal Office. SMS includes name of the postal office where Customer can pick up the Product. Product is kept in the postal office for 14 days. After 14 days when the Customer has not picked up the Product, it will be sent back to the E-Store. Customer needs to pay a fee for new sending incase the Product was not picked up on time.

6.5. When choosing Omniva (Latvia) parcel machine shipping option, product will be delivered to the customer in 1-3 days after order confirmation to the customer has been sent. Customer will be notified via SMS once the Product has arrived. SMS includes door code, location of the parcel machine, return code and until which date the package will be kept in the parcel machine. Product is kept in the parcel machine for 7 days. After 7 days when the Customer has not picked up the Product, it will be sent back to the E-Store. Customer needs to pay a fee for new sending incase the Product was not picked up on time.

6.6. When choosing Smartpost (Finland) parcel machine shipping option, product will be delivered to the customer in 1-3 days (In Helsinki) and in 3-5 days (rest of Finland) after order confirmation to the customer has been sent. Customer will be notified via SMS once the Product has arrived. SMS includes door code, location of the parcel machine, return code and until which date the package will be kept in the parcel machine. Product is kept in the parcel machine for 7 days. After 7 days when the Customer has not picked up the Product, it will be sent back to the E-Store. Customer needs to pay a fee for new sending incase the Product was not picked up on time.

6.7. Customer has an obligation to make sure that all the data entered is correct before placing an order. This is needed to make sure that there will be no delayes or misunderstandings while delivering the Product. Seller is not taking any responsibility about delays or misunderstandings on delivering Product to the Customer caused by the not accurate or not correct data entry while placing an order.

6.8. If the Product does not arrive in good condition and in closed packaging, the Customer is obligated to notify the Online Store, sending a corresponding e-mail to info@suvesuss.ee

7. Exchanges and returns of the Products

7.1. The Customer has the right to exchange or return their ordered Product within 14 days. The 14 day term starts from receiving the order from courier or post office.

7.2 The Customer should send an email to the Seller with the request to return or exchange the Product within 14 days after receiving the Product.

7.3. The Seller will not cover the delivery costs of returns.

7.4. In the case of an exchange, the Online Store will send a new Product to the Customer immediately after receiving the Product that is to be exchanged.

7.5. The Seller shall refund the purchase price of the Product within 14 days as of the timely arrival of the Product at the Online Store. The money is refunded to the same bank account from which the Customer paid for the corresponding order.

7.6. In the case of refunding the purchase price, the Seller will not compensate the cost of transport service related to this purchase. In case of the exchange, the Customer needs to pay a fee for new sending according to the price list.

7.7. The Product that is to be replaced or returned cannot be damaged or have signs of having been worn, it must be in its original packaging and all original tags must be attached to the product.

7.8. The Customer is obligated to open the Product packaging carefully without damaging it. If it is not possible to open the package without damaging it.

8. Claims procedure

8.1. Pursuant to subsection 2 (218) of the Law of Obligations Act, a two year term for raising claims applies to the Products sold at the Online Store. Any disputes between the Customer and the Seller shall be solved by negotiations.

8.2. Pursuant to subsection 1 (222) of the Law of Obligations Act, the Customer has the right to demand the repair of the Product or delivery of a replacement Product if it does not conform to the contract. If the Product does not conform to the contract, the Seller shall cover all the costs related to repairing or replacing the Product, above all transportation, shipping, work, travel and material costs.

8.3. The Seller takes no responsibility for damages arising from the abnormal use of the products or for delays if they are due to circumstances the Seller could not affect and/or are conditioned by force majeure.

9. Liability

9.1. The Seller and Customer shall be liable to each other for the damage caused by violating these terms of use in the cases and to the extent provided by the legislation valid in the Republic of Estonia.

9.2. The Seller is liable to the extent of the purchase price.

9.3. The Customer is obligated to use the service of the Online Store only for purposes that are legal and in accordance with good practice.

10. Privacy policy

10.1. The Customer gives the Seller a clear and informed consent for processing their personal data.

10.2. The personal data given to the Seller shall be entered into the customer registry and will be used for providing sales service and offering products to the Customer.

10.3 The Seller stores the contact information and information about the purchases entered by the Customer during purchases. This information will be handled as confidential and is processed in accordance with the Personal Data Protection Act. The personal data necessary for delivery will be forwarded to a business providing courier service.

10.4. The Seller may only use the Customer’s personal data for sending information about special offers and campaigns to the Customer’s e-mail address if the Customer has given their consent.

10.5. Data exchange between the Customer and card payment centres is encrypted, ensuring the safety of the Customer’s personal data and bank information. The payment is carried out outside the online store of Suvesuss in a secure paying environment of the corresponding bank or service provider. The Online Store does not have access to the Customer’s bank or credit card information.

11. Terms of use and their alteration

11.1. Upon signing up or making a purchase, the Customer accepts the terms of use of the Online Store and is obligated to follow them.

11.2. The contract of sale between the Seller and Customer enters into force after the purchase price is transferred to the Seller’s bank account.

11.3. The Seller has the right to alter the terms of use and prices of the products of the Online Store. A notification about the changes made shall be published in the Online Store environment. The conditions and prices valid at the time of the transaction shall be applied to the transaction.

11.4. The Seller has the right to disclaim the execution of the order when the displayed price in the Online Store is incorrect due to a technical error.

12. Other conditions

12.1. Any disputes between the Customer and the Seller shall be solved by negotiations. If an agreement is not reached, the Customer has the right to turn to the Harju County Court, Consumer Protection Board and/

or Consumer Claims Commission to defend their rights.
